You take online privacy seriously, and so do we. We are providing our Privacy Policy to help you make informed choices about your personal information. This policy explains the privacy practices of JM&A Group — which consists of Jim Moran & Associates, Inc., Fidelity Warranty Services, Inc., Fidelity Insurance Agency, Courtesy Insurance Company, and Century Warranty Services, Inc. — when you contract with us, you access the Internet websites that we operate (the “Websites”), you otherwise interact with us, or we receive your information from others (such as when you work with a dealer on purchasing one of our offerings). Your access and use of our Websites is also governed by our Terms of Use.
Below you will find details about what personal information we collect about you, what we do with that information, and how you can control your information. To help you understand our privacy practices, we have provided the following brief overview covering what we believe are the key points:
- What personal information do we collect? We collect the following categories of personal information: identifiers; commercial information; internet or other electronic network activity; geolocation data; audio, electronic, visual, thermal, olfactory, or similar information; and limited sensitive personal information.
- How do we use your information? We use your personal information to fulfill our contractual obligations; customize our communications; perform administrative tasks; administer offers, promotions, and surveys; communicate with you; operate, evaluate and improve our business; and conduct data analysis. We may also use personal information to comply with the law, exercise our legal rights, and address fraudulent or similar malicious activity.
- Do we sell or share your information? We do not sell your personal information in the traditional sense, but we do make it available to third parties for cross-context behavioral advertising (which is commonly known as “targeted advertising” and also considered a sale in some jurisdictions) in order to provide you more relevant advertising. If you are a California resident, or live in one of the states noted below in the “Rights” section, you can elect to opt out of such activity by clicking here.
- How long do we keep your information? We retain personal information for as long as reasonably necessary to accomplish the purposes for which it was collected, and as necessary to comply with legal obligations and to protect our interests.

Collection
In the last 12 months, we collected the following categories of personal information:
- Identifiers. This includes information such as your title, full name, address, contact details, including your email address, home and mobile telephone numbers, vehicle identification number (commonly known as a VIN), correspondence address (where different from your home address); and address history (only for current contract holders). We also collect information relating to your use of our goods or services.
- Business Contact Records. This includes information such as your full name, signature, Social Security number, address, telephone number, driver’s license number, passport number, insurance policy number, and revolving credit account number. We only collect this information from individuals who work at or for companies who sell or provide our offerings.
- Commercial Information. This includes information such as records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
- Internet or Other Electronic Network Activity Information. This includes information such as your IP address, browser type, interactions you may have with the Websites. We collect this information when you use the Websites.
- Geolocation data. We collect your geolocation data when, while attending one of our sponsored events, you use a badge with location-tracking functionality.
- Audio, Electronic, Visual, Thermal, Olfactory, or Similar Information. This includes information such as audio or video recordings. It is our standard practice to record all external claims calls for training, compliance, security, and evidentiary purposes—even where these calls fall outside of our regulatory obligations. Some of our offices use closed circuit television cameras for health, safety, and security purposes—so, if you visit one of our offices, you may be recorded on those cameras.
- Sensitive Personal Information. We may collect your payment information, Social Security number, or driver’s license number. This information is considered sensitive information in some states.
We collect this personal information from: you, your device (when you visit the Websites); online-review platforms (such as Birdeye); your lender or insurance company; the car dealer from whom you purchased our product contract or contract we administer; or a repair shop in connection with our product contract or contract we administer.

Purpose

This includes activities such as developing new products, managing communications, determining the effectiveness of our sales, marketing and advertising, performing accounting, auditing, billing, reconciliation and collection activities, claims activities and analyzing and enhancing our products and branded websites.

Conduct Data Analysis. This includes activities such as performing analysis and other processing—including market and consumer research, trend analysis, and financial analysis.

We also use your information to (1) comply with applicable legal or regulatory obligations (including legal claims, compliance, and investigative purposes); (2) protect against identity fraudulent, malicious, deceptive, and other criminal activity; and (3) exercise our rights, including investigating, prosecuting, or defending legal claims. We may also use information for other purposes with your consent.
As required by law, we will obtain your consent before we process your sensitive personal information. We do not use your sensitive personal information for any reason other than those specified in California Civil Code section 1798.121(a). With the exception of payment data, we generally receive sensitive personal information (your Social Security or driver’s license number) when it is on a police report provided to us in connection with processing a claim under your contract. We do not use that sensitive information, and we only store it for so long as our record retention policy requires we keep a copy of the police report.

We collect information about you primarily to provide services through the Websites, but also for other purposes that include but are not limited to:

Vendors. This includes companies that perform services on our behalf, such as running our Websites or sending communications on our behalf. These companies, often called “processors” or “service providers,” can only use personal information for the purposes we specify.

We disclose personal information to our affiliates to provide you more relevant products, services and advertising and for marketing and analytical purposes.

Business Partners. This includes companies whose products we sell or who assist us in providing our offerings. For example, if JM&A Group partners with a third-party for a joint service (such as service repairs), we may share your information with that third party.
We disclose personal information to our business partners so that they can provide you the services you purchased.

We may also disclose personal information to others who are not third parties under applicable privacy laws. For example, we may disclose information (1) as required by law, (2) to law enforcement or in response to legal process (such as a subpoena), (3) in connection with a corporate restructuring (such as a merger or acquisition), (4) to address situations where we believe there was a violation of our Websites’ policies, and (5) if we believe that someone may be causing injury to rights/property of JM&A Group or others.
We do not disclose personal information to third parties for their own direct marketing purposes.
Profiling, Selling, and Targeted Advertising
We do not use your personal information for profiling—as the term is defined under applicable privacy laws—in furtherance of decisions that produce legal or similarly significant effects concerning you.
We also do not sell personal information in the traditional sense: giving your data to another in exchange for money. We do, however, allow trusted partners to collect some of your data so we can provide you targeted advertising based on your interactions with us and others online. Some states may consider this practice as us “selling” or “sharing” your information. In the last 12 months, we allowed companies to collect the following category of personal data for targeted advertising: Internet or other Electronic Network Activity Information. We do not have actual knowledge that we sold personal information of any person under 16 years old or shared such information for targeted advertising.
Some browsers have “do not track” features that allow you to tell a website not to track you. These features are not all uniform. We do not currently respond to those signals. But we do offer you the right to opt out of us selling or sharing your personal information. You can do so by following the instructions in the “Choices and Rights” section below or relying on an opt-out preference signal, such as the Global Privacy Control. To the extent possible, we respond to those signals on our Websites for the browser sending the opt-out signal. (If you later access our website from a different browser that is not sending the signal, your opt-out settings will not carry over.)

Choices
You may opt out of receiving promotional or marketing material at any time by contacting privacy@jmagroup.com or by following the opt-out instructions included in the communications you receive. Your option not to receive promotional and marketing material will not preclude us from (1) corresponding with you regarding your existing or past business relationships with us (e.g., use of our services or responses to requests for information to us either through use of our Websites or other means), or (2) accessing and viewing your information in the course of maintaining and improving our Websites and our services.
Additionally, your browser may provide options for limiting our use of cookies or other tracking tools. Note that if you choose to disable cookies, it is possible that some of our Websites’ features may not function properly. In addition to your browser’s settings, you can find information on controlling cookies by visiting www.allaboutcookies.org.
You can also opt out of certain cookies or similar tracking by following the instructions provided by the companies who provide those tools. We also use the following online tools that provide their own opt-out mechanisms:
- Google Analytics — To help facilitate the delivery of relevant content, we may use Google Analytics to collect information about user interactions on our Websites. We may use that data for optimizing marketing, refining advertising, and generally making advertising more effective. Rights
As required by state law, we provide additional options for residents of certain states to exercise control over their personal information. Residents of California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Minnesota, Montana, Nebraska, Nevada, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, or Virginia have the following rights:
- Access. You can request that we provide you details about the personal information we collected about you and how we used it (including any disclosures to third parties). You can also ask to receive the specific pieces of personal information we collected about you as well as the names of third parties to whom we disclosed personal information.
- Delete. You can ask us to delete the personal information we have collected about you.
- Correct. You can ask us to correct inaccurate personal information we maintain about you.
- Opt Out of Sales and Targeted Advertising. You can ask us to not sell your personal information or use it for targeted advertising (which California calls “sharing”) based on your online activity.
- Learn of Direct Marketing. You can ask us once per year if we have shared personal information with third parties for their direct marketing purposes.
- Revoke Consent. You have the right to revoke your consent to our processing of your sensitive information, when our processing is based on that consent.
- We will not discriminate or retaliate against you for exercising the above rights.

In this circumstance, we will need to verify both your appointment of the agent and the agent’s identity when the request is submitted.
Before fulfilling your request, we must be confident you are seeking to exercise rights concerning your information (or rights belonging to your child) or acting as an authorized agent for another individual. We will take reasonable steps as allowed by law to verify your identity. In order to verify your identity, upon receiving your request to access, correct, or delete your information, we will compare the information you provide against our records. If we need additional information, we will reach out to you to discuss alternative ways for us to verify your identify.
If we are unable to honor your request, we will tell you and explain why. When we do so, you may appeal our decision by emailing us at privacy@jmagroup.com. In your email, please identify what decision you are appealing and concisely state why you believe your request should be fulfilled.
Security
We recognize the importance of maintaining the security of your information. We have implemented technical, administrative and physical security measures designed to protect your information from unauthorized access, disclosure, use and modification.
Children’s Privacy
Our Websites are not directed to children under the age of 13, and we do not knowingly collect personal information from children under the age of 13.
International Data Transfers
If we collect your personal information, it may not be subject to your country’s laws. We may collect the information in another country or transfer that information from your country to other countries around the world. The countries where we collect or transfer personal information may have data privacy and security laws that are different than your country.
User-generated Content and Public Profile Features
The JM&A Group’s Websites may contain interactive areas where users might submit comments or other content (including information about the user that might be displayed in the user’s public profile within an online community) that may be posted on the Websites or otherwise published. Users who do this should be aware that when they voluntarily disclose personal information in content submitted for posting or publication, the information can be read and used by others. This may result in unsolicited messages from other posters or parties. We make no representations and undertake no obligations as to the security or use of information you voluntarily include when submitting content.
Third-Party Websites
This Privacy Policy applies solely to information collected on the Websites. Our Websites may contain links to other websites. We are not responsible for the privacy practices or the content of those websites.
Social Networking Websites
If you choose to access or use third-party social networking services (such as Facebook, Twitter, or Yelp), we may receive personal information about you that you have already made available to those services, including information about your contacts on those services. The JM&A Group will not sell such information or use the information in a manner that is inconsistent with this Privacy Policy. Your decision to use a social networking site to interact with us will always be voluntary.
Privacy Policy Updates
We reserve the right to update this Privacy Policy at any time. When we do, we will post it on our Websites and change the last updated date. If there are material changes to our policy, we will post a prominent notice on our Websites and/or provide other notice as required by law.
