You take online privacy seriously and so does the JM&A Group (which includes Jim Moran & Associates, Inc., Fidelity Warranty Services, Inc., Fidelity Insurance Agency, Century Warranty Services, and Courtesy Insurance Company).  Our aim with this privacy policy is to help you make informed choices about your personal information. This privacy policy explains what personal information we collect about you, what we do with it, and how you can control it in connection with our websites or other online services. This privacy policy also applies to the personal information we collect through hardcopy means.

1. Who We Are And How To Contact Us.

The JM&A Group is one of the largest independent providers of finance and insurance (F&I) products in the automotive industry.  In this role, the JM&A Group may collect and control your personal information. Personal information is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you. This privacy policy describes how we deal with your personal information. 

It is important for you to know that the JM&A Group is comprised of five (5) companies that may each have a different name than the JM&A Group (these companies are listed above). However, each of these companies is actually part of the JM&A Group. As such, the way these companies process your personal information is also captured within this privacy policy. Where we use terms such as we, us and our in this privacy policy, we mean the JM&A Group and all of its companies, even if they have a different name.

2. Categories Of Personal Information We Collect, Where We Collect It From, Why We Collect It, And Who We Share It With. 

To help you understand our privacy practices, the following table shows, for the past twelve (12) months: which categories of personal information we have collected, the categories of sources from which we collected personal information, our business or commercial purposes for collecting the information, and the categories of third parties with whom we have shared personal information:

Identifiers such as your title, full name, address, contact details, including your email address, home and mobile telephone numbers, correspondence address (where different from your home address); and address history (only for current contract holders).  We may also collect information relating to your use of our service.

This information is collected from the car dealer from whom you purchased our product contract(s) or contract(s) we administer. 

We also collect personal information from you directly through discussions and taking notes during the claims process, on our forms, or in your correspondence with us.

Purposes

This information is collected for the purpose of performing our contracts or administering others’ contracts with you and to enable us to comply with legal obligations. 

The information is used to determine your eligibility for our products or services; to communicate with you about your products or services; to evidence your ownership of a vehicle or product; to verify that your instructions are genuine and to process them accordingly; where applicable, to allow you to exercise rights in relation to your products or services (such as filing claims); to recover any amount owed to us or a third party whose services are linked to the service we provide to you; and to investigate and deal with complaints or disputes.

We also use your personal information for our internal and marketing purposes including recording incoming and outgoing calls for training, monitoring, and security purposes, as well as to keep an accurate record of any instructions received from you; administering and managing your contract(s), product(s) and service(s) relating to that, including, where necessary, updating your records and taking steps to update your contact address so we can contact you; to adhere to guidance and best practice under the regimes of governmental and regulatory bodies such as such as state departments of insurance, tax authorities, and regulators; for management and audit of our business operations including accounting. 

We may also use your personal information to determine the target market for our existing and future products (e.g. determining whether a product is meeting the needs of customers generally); and for marketing communications (where it is lawful for us to do so).  

In addition to the above, we collect the following information from you when required: where you have an online account with us, such information that is used to secure your online account, the answers to security verification questions, your username and password; if your vehicle requires an inspection, we may collect your vehicle’s physical image during the inspection; and where you have tax reporting duties, we collect information to allow us to carry out this reporting.

Lastly, we may use your personal information as part of our efforts to comply with the laws and regulations governing our industry.  In such cases, your information may be used to verify your identity and to carry out regulatory checks (such as cancellation refund audits); to ensure our services provided to you are legal and/or appropriate; recording incoming and outgoing calls for regulatory purposes; to carry out monitoring of purchases and cancellations for continued compliance with our regulatory obligations and to keep records of the transactions we’ve undertaken; and for establishment, defense and enforcement of our legal rights.

There may be other instances where we use consent to process your personal information. If we do, we will provide you with further information about the purposes of the processing at the time we ask for your consent.

We may share your personal information with third parties. There are times when we are mandated by law to disclose your personal information to third parties (such as tax authorities).

Additionally, we contract service providers to help us run our business and where we do so, we will also disclose your personal information to those service providers. 

We may also share your information with our professional advisors, such as lawyers, accountants, actuaries; with JM Family Enterprises, as our parent company; and with regulators and authorities in connection with their duties (such as insurance fraud prevention), and/or in connection with our compliance with legal and/or regulatory obligations.

This information may be collected from you, your car insurance company or your lender.

Purposes

We often need this information in order to provide services to you, particularly when you purchase a Guaranteed Asset Protection (“GAP”) product.  For example, if you request a payment or request for waiver of debt be made from us to your lender, we need your lender account information in order to do so.  If you do not provide this information to us, we will not be able to provide that service to you.

This information is collected when you attend sponsored events and are using a badge with tracking functionality.

Purposes

Attendees will be required to scan their location at sponsored events for security purposes. Attendees will be given a badge with an individual tracking mechanism during registration and will be required to wear the badge throughout the duration of the event.

It is our standard practice to record all external claims calls for training, compliance, security and evidentiary purposes even where these calls fall outside of our regulatory obligations.

Some of our offices use closed circuit television (CCTV) cameras for health, safety and security purposes. As such, if you visit one of our offices, you may have your image recorded on CCTV.  We may also deploy other access control mechanisms at some of our offices or branches, such as a visitor’s log, which you may be required to sign on entry which will also capture your personal information.

Purposes

We collect this information to have a record of what we have discussed with you and actions agreed with you, and for quality control and staff training purposes.

Additionally, some of our monitoring may be to comply with regulatory rules, self-regulatory practices or procedures relevant to our business, to prevent or detect fraud, in the interests of protecting the security of our physical locations and/or communications systems.

3. Sale of Personal Information.

We will never sell, rent or trade your personal information to an outside company.

4. Do Not Track.  

Some browsers have “do not track” features that allow you to tell a website not to track you. These features are not all uniform. We do not currently respond to those signals. Instead, we collect, use, and share information as described in this Privacy Policy regardless of a “do not track” choice.

5. Changes to Personal Information. 

Please contact us using the information below if any of your personal information changes, so that we can update our records.

6. Retention of Personal Information. 

We will only retain your personal information for as long as necessary to meet the reason your personal information was collected, or as necessary to comply with or satisfy all legal obligations including our obligations to keep records and to protect our interests.

7. Your Rights Under California Law.

You have the right to ask us to send you the following information:

  • The categories of personal data we have collected about you.
  • The categories of sources from which we collected the personal data.
  • Our business or commercial purpose for collecting personal data.
  • The categories of third parties with whom we share personal data.
  • The specific pieces of person information the business has collected about you.

You have the right to ask us to delete the personal data we have collected from you.

You have the right to ask us one time each year if we have shared personal information with third parties for their direct marketing purposes.

8. Non-Discrimination.

If you are a California resident and you want to submit a request regarding your California rights, please contact us using the information provided at the bottom of this privacy policy. If you exercise your privacy rights under California law, we will not discriminate against you for exercising those rights by: 

  • Denying you goods or services.
  • Charging you different prices or rates for goods or services, including through the use of discounts or other benefits, or imposing penalties.
  • Providing you a different level or quality of goods or services.
  • Suggesting that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

If you choose to exercise your right to request access to your personal information or your right to have your personal information erased, we will need to take reasonable steps to verify your identity before acting on your request. In order to verify your identity, upon receiving your request, we will send you an Identity Verification Form to complete and have notarized. The form asks for the minimal information (your name, address, telephone number, email address and either your Vehicle Identification Number (VIN) or contract number) we need to verify who you are and locate your personal information in our system.  

You may choose to appoint an agent to make requests on your behalf.  In this circumstance, we will need to verify both your appointment of the agent and the agent’s identity when the request is submitted.  Please reach out to our customer service representatives at 1-800-327-5172 so that we may provide specific directions for how to appoint an agent to make requests on your behalf. 

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

9. Data Anonymization and Use of Aggregated Information. 

Your personal information may be converted into statistical or aggregated data which cannot be used to re-identify you. It will then be used to produce statistical research and reports. This aggregated data will be shared and used in all the ways described in this privacy policy, and it may also be used in other ways not described here. However, as the information will be aggregated anonymous data, it will no longer constitute your personal information and can therefore be used more widely than if you could still be identified from it.

10. Future Changes to This Privacy Policy. 

We reserve the right to update this privacy policy at any time. When we do, we will post it on our websites and include the effective date of the update. 

11. How California Residents Can Submit Requests.
